Please read these Terms of Service ("Terms") carefully before using Cultivar ("the Service"), operated by Cultivation Clinical Services PLLC ("we," "us," or "our"), a Texas professional limited liability company. By creating an account or using the Service, you agree to be bound by these Terms.
Cultivar is a pre-session briefing tool designed for licensed mental health professionals. It allows users to paste session notes, which are processed by artificial intelligence to extract a structured briefing card. Raw notes are never stored. Only the therapist-approved briefing card is retained.
You must be at least 18 years old and a licensed or supervised mental health professional to use the Service. By using Cultivar, you represent that you meet these requirements and have the authority to enter into these Terms.
Cultivar is not a HIPAA-compliant platform and is not intended to be used as one. You agree that you will not input any Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA) into the Service. This includes, but is not limited to, patient names, dates of birth, addresses, insurance identifiers, or any other information that could be used to identify a specific individual.
You are solely responsible for ensuring that any information you enter into the Service complies with all applicable federal, state, and professional privacy laws and regulations, including HIPAA, your professional licensing board requirements, and applicable state mental health confidentiality statutes.
We expressly disclaim any liability arising from your input of PHI or other regulated information into the Service.
When you submit session notes for processing, the content is transmitted to a third-party AI provider solely for the purpose of generating your briefing card. Notes are processed transiently and are not stored by us or retained by the AI provider after processing is complete. Only the briefing card you explicitly approve is saved to your account.
You acknowledge that AI-generated briefing cards may contain errors or omissions and should be reviewed carefully before use. The Service is a productivity aid, not a clinical decision-making tool.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at admin@cultivationclinical.com if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.
Cultivar is offered on a subscription basis. Current pricing is:
Subscriptions are billed in advance through our payment processor, Stripe. By subscribing, you authorize us to charge the payment method on file on a recurring basis until auto-renewal is cancelled. All prices are in US dollars and are exclusive of any applicable taxes.
We reserve the right to change pricing at any time. If we change the price of your subscription, we will provide at least 30 days' notice before the new price takes effect.
You may cancel auto-renewal at any time by contacting us at admin@cultivationclinical.com. Cancellation turns off automatic renewal — your access continues until the end of your current billing period, at which point your account reverts to the Free plan. No refunds are issued.
If you believe you were charged in error, please contact us at admin@cultivationclinical.com within 30 days of the charge and we will review your request.
You may permanently delete your account at any time from your account settings. Upon deletion, all client profiles, session briefing cards, and account data will be permanently erased. This action cannot be undone. Deleting your account does not constitute cancellation of auto-renewal — please cancel auto-renewal separately before deleting if you do not wish to be charged at the next renewal date.

The Service, including its design, code, and content, is owned by Cultivation Clinical Services PLLC and protected by intellectual property laws. You retain ownership of any content you submit. By submitting content, you grant us a limited license to process it solely for the purpose of providing the Service to you.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or suitable for any particular clinical purpose. You use the Service at your own professional discretion and risk.
To the maximum extent permitted by law, Cultivation Clinical Services PLLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
